What exactly is personal data?

Personal data is information that can identify a natural person or make them identifiable. This means that, even if certain information does not identify the person right away, the mere fact that it can be cross-referenced with other data and, from there, identify them means that privacy obligations must be observed.

In other words, the Law considers personal data to be any data that can identify the data subject, directly or indirectly.

Examples include name, RG (Brazilian ID card), CPF (Brazilian individual taxpayer number), email, and cookies, a concept explained in this document.

What personal data do we collect?

To serve our customers, we process the following personal data:

• Name
• Email
• Phone
• CPF (Brazilian taxpayer number)
• Address

Leadlovers provides a hosting service to its customers, who are responsible for managing the data and information of the data subjects.

How do we obtain personal data?

We only use legitimate databases, which means we comply with the rules of the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados, “LGPD”). To provide our services, we obtain personal data, directly or indirectly, in the following ways:

• When you sign up for our plans or services;
• When you access the platform as a customer;
• When you access the platform as a user, whether as a student of an online course or as a customer;
• When you register on Leadlovers websites; and
• When you interact with Leadlovers customer service channels.

How do we use personal data?

We only use data to provide our services and according to our customers' needs.

Accordingly, your data may only be used for:

• Chatbot

  Operating chatbots and the automated support they provide, offering users a better experience and faster service, at the data subject's convenience;

• Email marketing

  Managing, planning, organizing, and sending marketing messages, according to the preferences set by users, customers, and sponsors.

• Course platform

  Hosting and developing courses and training programs delivered by our customers to platform users.

• Marketing automation

  Setting up rules and organizing targeted marketing strategies, according to our customers' guidelines.

What are the legal bases for processing data?

In short, legal bases are the reasons why personal data is processed.

Therefore, in every operation involving personal data, we rely on one of the following legal bases for processing it:

• Free and specific consent of the data subject;
• Compliance with a legal or regulatory obligation;
• Performance of a contract for the benefit of the data subject;
• Regular exercise of rights in judicial, administrative, or arbitration proceedings;
• Legitimate interests of the controller or third parties, always respecting the rights of data subjects; or
• Credit protection, in accordance with applicable law.

Furthermore, whenever we process personal data based on consent or legitimate interest, any data subject may request that the processing be stopped, following the procedure set out in this policy.

What about job applicants' personal data?

In order to attract the best talent, we at Leadlovers need to process the personal data of people who apply for our advertised job openings.

To carry out this process more effectively, we also rely on the Gupy platform, which collects and performs an initial screening of potential candidates' information, and whose privacy policy (in Portuguese) can be found here.

To make filling out the application easier or to improve your experience, you may choose to import information from other databases, as permitted by Gupy.

All of this data is processed on the basis of pre-contractual procedures, compliance with a legal obligation, or legitimate interest.

Diversity and inclusion initiatives

We at Leadlovers care about diversity and inclusion in the workplace.

To that end, we ask our candidates about their place of origin, gender identity, sexual orientation, and ethnicity.

All of these questions are entirely optional, and candidates may choose whether or not to answer them.

Data sharing

We may share your data in the following cases:

• Service Providers.

  We use third-party service providers to help us manage certain activities and services on our behalf, such as screening candidates, sending emails, text (SMS) and voice messages, serving ads, and tracking the effectiveness of marketing campaigns.

• Government agencies and entities.

  In certain situations, we must share certain personal data to comply with applicable law or to exercise rights in judicial or administrative proceedings.

• Protection of Leadlovers systems.

  We may also need to share personal data to protect our sponsors, customers, and users, for example, in the event of fraud attempts on our servers or to keep our protection systems working.

Compliance with Export Control Laws

Leadlovers operates in compliance with applicable export control and economic sanctions laws and regulations, including, but not limited to, the laws of the United States of America. This means we may be prevented from providing our services to, or accessing the data of, users located in, or who otherwise engage in transactions with, certain countries, regions, entities, or individuals subject to sanctions.

By using our services, you acknowledge and agree that Leadlovers reserves the right to restrict access to, or terminate the accounts of, users located in embargoed or sanctioned jurisdictions, or who violate applicable export control laws, without prior notice. In such cases, Leadlovers may be required to suspend or stop processing your data, in accordance with legal requirements.

How do we keep personal data secure?

We adopt strict technical, physical, and organizational measures to protect any and all information in our custody, including the personal data we collect, always meeting the highest security standards.

However, it is important to note that, although we have taken strict measures to protect personal data, no website, product, device, online application, data transmission, or computer system is completely secure.

What are your rights?

The Brazilian General Data Protection Law grants data subjects a number of rights, including rights they may exercise directly against those who carry out the processing operations.

Accordingly, data subjects may directly exercise any of the rights listed below:

• confirmation that their data is being processed;
• access to their personal data;
• correction of incomplete, inaccurate, or outdated data;
• anonymization, blocking, or deletion of unnecessary or excessive data;
• portability of their personal data, subject to trade secrets;
• deletion of personal data processed with their consent;
• information about the public or private entities with which their data has been shared;
• information about the option of not giving consent and the consequences of refusing; and
• withdrawal of consent, where applicable.

Ownership and Use of the Platform

Leadlovers holds all intellectual property rights over its platform and the content made available on it. By using our services, you agree that access to and use of the platform are strictly limited to its intended purpose. Any unauthorized commercialization, resale, or distribution of the platform or its features by third parties is prohibited, as it would violate our property rights and the service's terms of use. Your personal data will be processed in accordance with this policy, regardless of how you use the platform, provided that such use complies with our rules.
